From everyone at Roomsly, thank you for using our hotel management platform! We build Roomsly to help hoteliers manage their properties efficiently. Because we serve thousands of hotels and need to maintain a secure, fair platform for everyone, we have established these Terms of Service.


Definitions

  • "Company", "we", "our", or "us": Roomsly, the hotel management platform
  • "Services": The Roomsly web application, dashboard, and any related services provided by Roomsly
  • "You" or "your": The hotel, property, or organization that owns an account with Roomsly

We may update these Terms of Service in the future. When you use our Services, you are agreeing to the latest Terms.


Account Terms

  1. Account Security: You are responsible for maintaining the security of your account and password. Roomsly cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  2. Acceptable Use: You may not use Roomsly for any illegal purpose or to violate any laws. You may not use the Services to manage properties you do not have legal authority to operate.
  3. Account Responsibility: You are responsible for all activity that occurs under your account, including bookings, customer data, and financial transactions.
  4. Human Users Only: You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
  5. Minimum Age: You must be at least 18 years old or have legal guardian consent to use Roomsly.

Payment, Refunds, and Subscription Terms

  1. Free Trial: Roomsly may offer a free trial period. After the trial ends, payment is required to continue using paid features.
  2. Subscription Billing: Subscription fees are billed monthly or annually based on your selected plan. Fees are based on the number of rooms at your property.
  3. Plan Changes: You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.
  4. Refunds: Refunds are handled on a case-by-case basis. Contact roomsly.app@gmail.com for refund requests.

Cancellation and Termination

  1. Your Right to Cancel: You may cancel your Roomsly account at any time through the dashboard or by contacting support.
  2. No Proration: Cancellation takes effect immediately; we do not automatically prorate unused subscription time.
  3. Termination by Roomsly: We reserve the right to suspend or terminate your account for violations of these Terms or for any other reason at our discretion.
  4. Abuse: Verbal, physical, written, or other abuse of Roomsly employees will result in immediate account termination.

Service Modifications and Availability

  1. Service Changes: We reserve the right to modify or discontinue any feature of Roomsly with or without notice.
  2. Price Changes: We may change subscription prices with at least 30 days notice via email.
  3. Service Availability: Roomsly is provided "as is" and "as available" at your sole risk. We make no guarantees of uninterrupted service.

Data, Security, and Privacy

  1. Data Ownership: You retain ownership of all data you enter into Roomsly, including guest information, bookings, and financial records.
  2. Security: We protect your data through encryption, secure backups, and industry-standard security practices.
  3. Data Access: Roomsly staff access your data only for: (a) providing customer support, (b) fixing technical issues, (c) maintaining security, or (d) legal requirements.
  4. Privacy: Your data is never sold to third parties. We use trusted third-party vendors for hosting and infrastructure only.

Intellectual Property

  1. Your Content: You retain all rights to content you create in Roomsly. You grant Roomsly a limited license to use this content solely to provide the Services.
  2. Roomsly Property: Roomsly owns all intellectual property rights in the Services, including code, design, logos, and trademarks. You may not copy, reproduce, or exploit any portion of the Services without written permission.

Disclaimer of Warranties

Roomsly is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Services will be error-free, uninterrupted, or meet your specific requirements. We do not guarantee that all reported bugs will be fixed.


Limitation of Liability

To the maximum extent permitted by law, Roomsly shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • The use or inability to use the Services
  • Unauthorized access to your data or bookings
  • Any errors or omissions in the Services
  • Any other matter relating to these Terms or the Services

Guest Data and Compliance

  1. Guest Privacy: You are responsible for complying with all applicable privacy laws when collecting and storing guest information.
  2. Data Processing: Roomsly acts as a data processor for guest information you store in the system. You remain the data controller.
